In Colorado, one of the limitations imposed on governmental entities by the Tabor Amendment is the ability to hold multi-year contracts. To hold a multi-year contract, the contract must contain a "non-appropriation" clause that allows the termination of the contract at the end of each year. This limited the ability of charter schools to secure bonds funds for land purchases and facility construction. As a result, charter schools form a Building Corporation that secures a multi-year bond for the purchase or building of facilities, and then leases the facility to the charter school at the actual cost of the bond premium. The JA Building Corporation Board consists of 2 JA Board President, JA Board Treasurer and one JA Member at Large who meet annually to approve the on-going of the JA Elementary and JA Secondary buildings.
